Tutor Terms of Engagement

General
Once a tutoring position has been confirmed, you are entering into a contract between you (the tutor) and the client (the student, or the students parent/guardian).  T
he Cambridge Tuition Group acts as an agent on behalf of the tutor and the student.  The Cambridge Tuition Group is only responsible for finding students and an appropriate teacher for the specific subject and is not responsible for the content of lessons and the teaching methods.

The terms of contract entered into with the client shall be in the form provided unless otherwise agreed by the Cambridge Tuition Group.

Private Arrangements
In consideration of providing you with students, you are not permitted to make private arrangements for tuition with clients introduced by
the Cambridge Tuition Group or with new clients introduced by your current or previous Cambridge Tuition Group clients.  Should you breach the obligation, you will be liable to account for all sums received by you from the client/new client without deduction and the Cambridge Tuition Group shall be entitled to obtain an injunction against you to prevent further breaches.  This obligation shall continue notwithstanding termination of the Agreement.

Any work referred to a tutor by a client of the Cambridge Tuition Group must be billed through the Cambridge Tuition Group on your behalf.

Profiles
The Cambridge Tuition Group requests that your profile be up to date, this includes a photo.  We ask that you check that your profile in Tutor Cruncher includes all the subjects (and levels) you would like to teach.  If this is not up to date then you may not hear about available jobs or be able to register for them.

 

Environment
You and the client are responsible for finding and agreeing on a suitable environment in which tuition can take place.  If the lessons are taking place online, please ensure that you are providing tuition in line with our Online Safety Policy.

 

Payment
The Cambridge Tuition Group will agree the fee structure with the client and this must not be changed without written authority of the Cambridge Tuition Group.

As part of the service, the Cambridge Tuition Group will invoice the clients for your fee. The Cambridge Tuition Group invoices clients on behalf of tutors, based on the lessons recorded in Tutor Cruncher.  Your payments will be processed via Stripe, and paid to your bank account directly.

Please ensure that you check that the lessons confirmed in Tutor Cruncher correctly reflect the lessons that took place, and mark lessons complete within three days of that lesson being undertaken. If there is incorrect information in TutorCruncher, then your payment may be delayed.  Payments will only be made once the invoices have been paid by the client.

The Cambridge Tuition Group recommends that tutors keep a signed record of all lessons taught (or cancelled with less than 24 hrs notice) and expenses agreed with the client (signed by client after each lesson).  We do not need to see this but if a client disputes hours that are invoiced, we will be unlikely to be able to pay tutors if this record has not been signed.  Alternatively, thorough lesson reports are useful justification that lessons did, in fact, take place should there be a dispute.

You will not be paid directly by the client.  The Cambridge Tuition Group sends an invoice to the client, on behalf of and as an agent for you (the tutor), either after each lesson at the point that the lesson is marked as 'complete', or at the beginning of each calendar month to cover the previous month's tuition.  Our payment terms are 14 days.  You will not be entitled to receive your fee until the Cambridge Tuition Group has received payment from the client.  If the Cambridge Tuition Group does not receive payment in reasonable time, tutors may obtain written permission for a Director of the Cambridge Tuition Group to contact the client directly.

You must not accept any payment direct from the client without the written permission of a Director of the Cambridge Tuition Group.  Should you do so, all sums received by you will be immediately payable to the Cambridge Tuition Group and shall be actionable through the Courts without further notice to you.

You undertake to  the Cambridge Tuition Group that you will duly pay the tax and national insurance contribution which are due from you whether in the United Kingdom or elsewhere in relation to the payments to be made to you by the Cambridge Tuition Group under this Agreement and further agree to indemnify the Cambridge Tuition Group in respect of all and any income tax and national insurance contributions which may be found due from on any payments made to you under this agreement together with any interest, penalties or other fees thereon.

It is understood that you are not VAT registered.  You must inform us if this is not the case or if this changes.

Expenses
All expenses (books, travel, etc) must be agreed with the client before you add them to your account.  If you buy books, please keep receipts so you can return them to the shop if the client does not want to buy them.  Any expenses incurred by you without the agreement of the client will not be reimbursed to you.

Cancellation policy
Both the client and the tutor must notify the other in advance of any holiday commitments they may have and any changes to the tuition timetable necessary because of illness.  An alternative date may be arranged.  T
he Cambridge Tuition Group has a 24-hour cancellation policy with the client so that the Cambridge Tuition Group can charge them if they cancel the lesson at short notice.  You need to have agreed this and the chargeable cancelled hours with the client before the Cambridge Tuition Group will charge for them.  The tutor must notify the Cambridge Tuition Group as soon as possible and within 24 hours of the time of the original lesson in case of a late cancellation to claim the charges.

Damages
The Cambridge Tuition Group do not accept liability for any claims by the client arising out of or related to the carrying out of the tutoring by you and you agree to indemnify the Cambridge Tuition Group without limit in respect of any such claims.

 

Confidentiality
You undertake that you shall not at any time during this agreement and for a period of five years after termination of this agreement, disclose to any person  any confidential  information concerning the business affairs, customers, clients or suppliers of except that you may disclose
the Cambridge Tuition Group’s confidential information as may be required by law, court order of any governmental or regulatory authority.

You shall not use the Cambridge Tuition Group’s confidential information for any purpose other than to perform your obligations under this agreement.

Data Protection Act
The Cambridge Tuition Group uses tutor data for the purposes of the services that it provides.  Tutors providing personal data consent to the use of that data by the Cambridge Tuition Group for the purpose of effecting introductions to clients, for billing and fee collecting purposes and to enable the Cambridge Tuition Group to contact the tutor from time to time.

Safeguarding

Tutors will familiarise themselves with both the Safeguarding Policy and, if applicable, Online Safety Policy of the Cambridge Tuition Group.

Tutors are required to hold an Enhanced DBS Check that is no more than one year old, or to have signed up to the DBS Update Service.

The Cambridge Tuition Group reserves the right to alter these terms and conditions.  The Cambridge Tuition Group will, however, notify you in writing of any changes.

Unless otherwise agreed in writing by a Director of the Cambridge Tuition Group these Terms and Conditions shall prevail over any other terms of business or conditions put forward by you.

No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by a Director of the Cambridge Tuition Group.
